Berkshire Search and Consulting, Inc. Fee Schedule   A.   The fee for the Services of Berkshire Search and Consulting, Inc. is earned when the candidate accepts an offer to perform services by the employer, or any of its affiliates, as a result of our efforts. The fee is based on 25% of the estimated annual gross earnings, wages or salary of the candidate at the time of acceptance. For a Sales position, where the earnings are expected to be at least 40% from commission and 60% from a base salary, then Berkshire Search and Consulting, Inc. and the Hiring Authority will in good faith put an estimate of the expected commissions and include this figure in determining the correct fee.  B.   An invoice will be submitted for the services of Berkshire Search and Consulting, Inc. on or before the proposed start date of the candidate. The invoice is due and payable within thirty (30) days after the candidate starts employment.  C.   In the event litigation arises surrounding the fee agreement, or the terms herein, Berkshire Search and Consulting, Inc. shall be entitled to costs, reasonable attorney's fees and other necessary expenditures in addition to whatever other relief may be awarded over and above our base fee. If our candidate leaves your employ within 90 days we will replace the candidate at no charge.  D.   Hiring should be based on a person's competence and ability to meet specific job requirements and performance.
